Build & Retainer Terms

One-time site build

The build is a fixed-scope productised service quoted up-front. 50% of the build fee is payable on signing the kickoff agreement; the remaining 50% is payable at launch. The build includes the inclusions listed in your selected tier and two rounds of revisions during the four-week build window.

Maintenance retainer

The maintenance retainer is month-to-month and begins the day the site goes live. It renews monthly until cancelled. There is a 90-day initial commitment so the rankings and AI-search setup have time to take hold.

Cancellation

You may cancel the retainer at any time after the 90-day initial commitment by emailing josh@kovus.dev. Cancellation takes effect at the end of your current paid month. The website itself stays yours indefinitely.

Ownership of deliverables

You own your website source code, content, domain, and Google Business Profile from the day the build launches. On request, we hand over the code repo. Ongoing services (hosting, monitoring, GBP cadence, review automation, content engine, monthly reporting) cease on cancellation, but the static website remains yours and can be re-hosted elsewhere.

Service Level

We respond to client communications within 1 hour during AWST business hours (Mon–Fri, 8am–6pm). Outside these hours, response by next business day morning. Pro Growth retainer clients have a 4-hour emergency-fix SLA outside business hours.

Refunds

Build fees become non-refundable once the discovery call is completed and brand work has begun. Retainer fees for the current billing period are non-refundable. Cancellation simply stops future billing.

Limitation of liability

Kovus's total liability for any matter arising from this agreement is capped at the total fees paid by you in the preceding three months. Nothing in these terms excludes any liability that cannot be lawfully excluded under Australian Consumer Law.

Governing law

These terms are governed by the laws of Western Australia.
