Clear terms for training and billing.

These terms apply to the Secondwind iOS app published by Josh Waller, trading as Kovus. Secondwind provides general fitness education, programme planning and workout tracking. It is not medical care.

Fitness and wellness only

Secondwind is not a medical device and does not diagnose, treat or prevent any condition. It does not replace advice from a doctor, physiotherapist or other qualified professional.

You are responsible for deciding whether an exercise is appropriate for you. Use a comfortable range, follow equipment instructions, and stop if you experience sudden, severe, worsening or concerning pain or symptoms. Seek qualified care when needed. Call 000 in an emergency in Australia.

The programme and Coach

Starting loads and progressions are conservative estimates based on your answers and training feedback. They are not a strength test or clinical assessment. Exercise illustrations and cues are general guidance.

Coach is an automated feature. It can explain programme logic, form cues and ordinary session adjustments. It is not a human coach or clinician. Do not rely on Coach for diagnosis, medical advice, supplement advice or emergency help.

Subscriptions

Secondwind offers monthly and annual auto-renewing subscriptions. The price, billing period and any offer are shown in the app before purchase. There is no free trial unless the App Store purchase screen expressly states otherwise.

Payment is charged to your Apple ID when you confirm the purchase. A subscription renews automatically unless you cancel it through your Apple subscriptions settings before the end of the current billing period. Apple controls the exact renewal timing, billing, cancellation and refund process. Deleting the app does not cancel a subscription.

You can reach Apple's subscription management in one screen from Secondwind Settings. Annual subscribers can choose a local reminder scheduled three days before the recorded renewal date. A reminder is a convenience and does not change Apple's billing terms.

Purchases, restore and availability

Use Restore purchases if an active subscription is not recognised. Access depends on a valid App Store transaction and RevenueCat entitlement. Features may be unavailable during maintenance, network interruption or a third-party service outage. The programme and built-in quick Coach answers are designed to remain available offline after setup.

Acceptable use

Do not misuse the app or Coach service, attempt to bypass limits, probe or disrupt the service, submit unlawful content, or use automated means to make requests. We may limit or disable the online Coach service to protect users, reliability or costs.

Intellectual property

Secondwind, its programme structure, copy, illustrations and software are owned by Kovus or used under licence. Your subscription gives you a personal, non-transferable right to use the app. It does not transfer ownership or permit copying, resale or commercial redistribution.

Your data

The privacy policy explains local storage, custom Coach processing, subscriptions and deletion.

Consumer rights and liability

Nothing in these terms excludes rights or remedies that cannot lawfully be excluded, including guarantees under the Australian Consumer Law.

To the extent permitted by law, Kovus is not liable for indirect or consequential loss arising from use of the app. Where liability can lawfully be limited, it is limited to supplying the relevant service again or paying the cost of having it supplied again.

Changes and ending use

We may update the app and these terms to improve reliability, meet legal requirements or reflect service changes. You may stop using Secondwind at any time. Cancelling a subscription stops future renewals but does not usually create a refund for the current period. Refund requests are handled by Apple.

Governing law and contact

These terms are governed by the laws of Western Australia and the Commonwealth of Australia. Courts with jurisdiction in Western Australia may hear disputes, subject to any mandatory consumer right to bring a claim elsewhere.
